Wallit Privacy Policy

1.                   Scope and Consent.  You accept this Privacy Policy when you sign up for, access, or use the iMoneza, LLC d/b/a Wallit (“Wallit”, “our”, “us” or “we”) products, services, content, features, technologies or functions (collectively, “Wallit Services”), offered on our website and our mobile application (collectively, our “Site”) or through websites of third party online merchants with whom we have a relationship (“Participating Merchants”). We may amend this policy at any time by posting a revised version on our website. The revised version will be effective at the time we post it.

2.                   Collection of Personal Information.  We collect the following types of Personal Information (as defined in the Wallit Consumer Terms of Use) in order to provide you with the use of and access to Wallit Services:

(a)                Information We Collect Automatically. When you visit our Site or use Wallit Services, we collect information sent to us by your computer, mobile phone or other access device. The information sent to us includes but is not limited to the following: data about the pages you access, computer IP address, device ID or unique identifier, device type, geo-location information, computer and connection information, mobile network information, statistics on page views, traffic to and from the sites, referral URL, ad data, and standard web log data and other information. We also collect anonymous information through our use of cookies and web beacons.

(b)                Information You Provide to Us. We may collect and store any information you enter on our Site or you provide to us in context of using the Wallit Services. When you visit our Site or use Wallit Services, we also collect information about your transactions and your activities. In addition, if you open a Wallit account or use Wallit Services, we may collect the following types of information: (i) Contact information, such as your name, address, phone, email and other similar information, (ii) financial information, such as the full bank account numbers and/or credit card or debit card numbers that you link to your Wallit account or give us when you use Wallit Services and (iii) detailed Personal Information such as your date of birth or identification numbers. We may also collect information from or about you in other ways, such as through your contact with our customer support team and your results when you respond to a survey. Additionally, for quality and training purposes or for its own protection, we may monitor or record our telephone conversations with you or anyone acting on your behalf. By communicating with us, you acknowledge that your communication may be overheard, monitored, or recorded without further notice or warning.

(c)                Information From Other Sources. We may also obtain information about you from third parties such as identity verification services. 

(d)                Authentication and Fraud Detection. In order to help protect you from fraud and misuse of your Personal Information, we may collect information about you and your interactions with our Site or Wallit Services. We may also evaluate your computer, mobile phone or other access device to identify any malicious software or activity.

3.                   Mobile Privacy. We may offer you the ability to connect with our Site, or use of our Wallit Services, using a mobile device, either through a mobile application or via a mobile optimized website. The provisions of this Privacy Policy apply to all such mobile access and use of mobile devices. This Privacy Policy will be referenced by all such mobile applications or mobile optimized websites. When you download or use our mobile applications, or access one of our mobile optimized sites, we may receive information about your location and your mobile device, including a unique identifier for your device. We may use this information to provide you with location-based services, such as advertising, search results, and other personalized content. Most mobile devices allow you to control or disable location services in the device’s setting’s menu. If you have questions about how to disable your device’s location services, we recommend you contact your mobile service carrier or the manufacture of your particular device. 

4.                   How We Use the Personal Information We Collect. Our primary purpose in collecting Personal Information is to provide you with a secure and smooth experience while using Wallit Services. We may use your Personal Information to: (a) provide Wallit Services and customer support, (b) process transactions and send notices about your transactions, (c) resolve disputes, collect fees, and troubleshoot problems, (d) prevent potentially prohibited or illegal activities, and enforce our Wallit Consumer Terms of Use, (e) customize, measure, and improve Wallit Services and the content, layout, and operation of our websites and applications; (f) deliver targeted marketing, service update notices, and promotional offers based on your communication preferences and (g) compare information for accuracy and verify it with third parties.  We may combine your information with information we collect from other companies and use it to improve and personalize Wallit Services, content, and advertising.

5.                   How We Use Cookies and Similar Technologies.  When you access our website or use Wallit Services, we (including companies we work with) may place small data files on your computer or other device. These data files may be cookies, pixel tags, “Flash cookies,” or other local storage provided by your browser or associated applications (collectively “Cookies”). We use these technologies to recognize you as a customer; customize Wallit Services, content, and advertising; measure promotional effectiveness; help ensure that your account security is not compromised; mitigate risk and prevent fraud; and to promote trust and safety across our Site and Wallit Services. You are free to decline our Cookies if your browser or browser add-on permits, unless our Cookies are required to prevent fraud or ensure the security of websites we control. However, declining our Cookies may interfere with your use of our Site and Wallit Services.

6.                   How We Protect and Store Personal Information.  We protect your Personal Information using physical, technical, and administrative security measures to reduce the risks of loss, misuse, unauthorized access, disclosure and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centers, and information access authorization controls. 

7.                   How We Share Personal Information with Third Parties.  We will not sell or rent any of your Personal Information to third parties for their marketing purposes without your consent and only share your Personal Information with third parties as described in this policy.  We may share your Personal Information with:

(a)                Service providers under contract who help with our business operations, such as fraud prevention, bill collection, credit card processing, marketing, and technology services. Our contracts dictate that these service providers only use your information in connection with the services they perform for us and not for their own benefit.

(b)                Credit bureaus and collection agencies to report account information, as permitted by law.

(c)                Banking partners as required by credit card association rules for inclusion on their list of terminated merchants (in the event that you meet their criteria which includes having Wallit close your Wallit Account due to your breach of the Wallit Consumer Terms of Use).

(d)                Law enforcement, government officials, or other third parties pursuant to a subpoena, court order, or other legal process or requirement applicable to Wallit or one of its affiliates; when we need to do so to comply with law or credit card rules; or when we believe, in our sole discretion, that the disclosure of Personal Information is necessary to prevent physical harm or financial loss, to report suspected illegal activity or to investigate violations of our Wallit Consumer Terms of Use.

(e)                Other third parties with your consent or direction to do so.

 

Additionally, we may share the contact information (i.e., name, user name, physical address and email address) that you provide during any log-in, access or use of Wallit Services with third party online merchants with whom you access content or from whom you obtain products and services through Wallit Services, whether or not a payment is required for such content, products or services.  Such merchants may use your contact information to send you marketing communications.  If at any time you no longer wish to have your contact information shared by Wallit with third party online merchants, you must discontinue using the Wallit Services.  Any requests to be removed from a merchant’s mailing or emailing list must be directed to the merchant; Wallit will not relay such requests to the merchant.

 

Please note that the information Wallit provides to the merchants with whom you transact using the Wallit Services and the information you provide to merchants when you visit their websites will be subject to their privacy policies.  Before you transact with a merchant using the Wallit Services or visit the merchant’s website, you should familiarize yourself with the merchant’s privacy policy.  Do not transact with a merchant unless you agree with the terms of the merchant’s privacy policy.

8.                   Disclaimers; Limitation on Liability.

(a)                Linked Sites.  Our Site may contain links to other affiliated or independent third-party websites (“Linked Sites”), including sites of Participating Merchants.  The Linked Sites are provided solely as a convenience to Users.  The Linked Sites are not under our control, and we are not responsible for and do not endorse or make any representations with respect to the content or practices of the Linked Sites, including any information or materials contained on the Linked Sites. You will need to make your own independent judgment regarding your interaction with any Linked Site.

(b)                Participating Merchant Goods and Services.  We do not and cannot review the goods or services provided by Participating Merchants.  The sites and the goods and services of Participating Merchants are not under our control, and we are not responsible for and do not endorse or make any representations with respect to the content or practices of the Participating Merchants, including any such goods or services.  You acknowledge that we are not undertaking any obligation or liability relating to such goods or services.  You acknowledge and agree that we do not guarantee access to any goods or services provided by any Participating Merchant or that Wallit Services will continue with any Participating Merchant.  Access to the goods or services of a Participating Merchant may cease at any time, whether temporarily or permanently. We do not have any control over the products or services that are paid for with the Wallit Services and we cannot ensure that a Participating Merchant you are dealing with will actually complete the transaction or is authorized to do so.

(c)                No Warranty

(d). THE WALLIT SERVICES ARE PROVIDED “AS IS” AND WITHOUT ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS, IMPLIED OR STATUTORY. WALLIT AND WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.  We do not guarantee continuous, uninterrupted or secure access to any part of the Wallit Services, and operation of our site may be interfered with by numerous factors outside of our control. Certain Wallit Services may not be available to you based on residency, geographic location or other eligibility criteria. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimers may not apply to you, and you may also have other legal rights that vary from state to state. 

9.                   How You Can Access or Change Your Personal Information. You can review and edit your Personal Information at any time by logging in to your account and reviewing your account settings and profile. You can also close your account through our Site. If you close your Wallit account, we will mark your account in our database as “Closed,” but may retain Personal Information from your account for a certain period of time to collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, prevent fraud, enforce our Wallit Consumer Terms of Use, or take other actions as required or permitted by law.
